Terms and Conditions - Divine Circle
Welcome to Divine Circle. By enrolling in any of our professional certification programs — including the Healing Breathwork Facilitator Training and the Sound Healing Training — or by attending any regular class, drop-in session, or event, you confirm that you have read, understood, and agreed to the terms set out below. These terms form a binding agreement between you and Divine Circle.

1. Health and Safety Declaration
Conscious Connected Breathwork and vibrational sound therapy both produce significant physiological effects. They alter the autonomic nervous system, shift blood chemistry, and can activate strong emotional and somatic responses. For this reason, honest health disclosure is a non-negotiable condition of participation.
Before enrolling or attending, you must:
- Complete the Divine Circle Health and Safety Questionnaire truthfully and in full
- Disclose any current or historical medical, psychiatric, neurological, or cardiovascular conditions that may be relevant
- Notify the Divine Circle team immediately if your health status changes between enrollment and the start of your program.
Absolute contraindications include — but are not limited to — recent heart attack or stroke (within 12 months), active epilepsy, unmanaged glaucoma, severe active psychosis or acute mania, first-trimester pregnancy, and current detoxification from alcohol or benzodiazepines. Participants with any of these conditions will not be admitted to intensive sessions. This decision is made in your interest and cannot be overridden.
Where a participant withholds a known health condition that subsequently causes harm during a session, Divine Circle’s liability is limited to the extent permitted by applicable law. Divine Circle remains fully responsible for any harm arising from its own negligence, willful misconduct, or failure to follow its own safety protocols.
2. Certification and Assessment Standards
Enrollment and payment do not automatically entitle a participant to receive a graduation certificate. Divine Circle is opting to be an IPHM-accredited training provider, and all certifications are issued in accordance with international accreditation standards.
A certificate will be issued only when a student has:
- Attended all required training hours and sessions
- Completed a minimum of five supervised Clinical Practicum Logs
- Passed the written examination with a minimum score of 80 out of 100
- Demonstrated safe, ethical, and professional conduct throughout the program
Students who do not meet these standards will not receive a certificate. One resit of the written examination is permitted within the program period. Where a student narrowly fails and demonstrates exceptional practical ability, Shiva may use discretion to offer an extended assessment window. This discretion rests entirely with Divine Circle.
Students who complete the program without meeting certification requirements will receive a Certificate of Participation confirming attendance, which is distinct from the professional qualification certificate.

4. Intellectual Property
All course materials, training manuals, session frameworks, methodology structures, and original content produced by Divine Circle are the exclusive intellectual property of Divine Circle and its lead facilitators. This includes written materials, digital content, audio recordings, and proprietary teaching methodologies.
Upon certification, graduates are granted a personal, non-exclusive license to apply these teachings in their own professional practice with clients and groups. This license does not include the right to:
- Reproduce, distribute, or sell any Divine Circle materials
- Use Divine Circle’s course content as the basis of your own teacher training program without explicit written permission
- Present Divine Circle’s methodology as your own original system without attribution
Graduates who wish to run facilitator training programs based on Divine Circle’s curriculum must enter a separate written licensing or partnership agreement. Enquiries should be directed to the Divine Circle team directly.
5. Scope of Practice and Representation
A Divine Circle certification qualifies the holder to facilitate breathwork sessions and sound healing sessions as a holistic wellness practitioner. It does not qualify the holder to practice as a psychotherapist, clinical counsellor, medical professional, or any other regulated clinical profession.
Graduates agree to represent their qualifications accurately at all times. Describing yourself as a ‘therapist’, ‘psychotherapist’, or ‘healer’ in jurisdictions where those titles are legally protected without the corresponding licensure is a misrepresentation that Divine Circle does not endorse and cannot be associated with.
Divine Circle’s accreditation through IPHM entitles graduates to apply for IPHM practitioner membership and to access IPHM’s affiliated insurance brokers in their home country. Insurance and regulatory requirements vary by jurisdiction. It is the graduate’s responsibility to understand and comply with the rules that apply in the country where they practice.
6. Professional Practice in Rishikesh
Graduates receive international certification to practice, hold space, and facilitate workshops anywhere globally across all domestic and international borders. However, to preserve the local lineage and maintain a balanced wellness ecosystem, graduates agree not to market or advertise breathwork facilitation training courses, sound healing certifications, and public workshops within the official city limits of Rishikesh, India.
- Retreat Exemption: You are completely free to host your own retreats in Rishikesh, provided that you bring your own participants from outside the city and do not actively market to or source clients from the local Rishikesh area.
7. Cancellation, Transfers, and Refund Policy
7.1 Certification Programmes
Divine Circle maintains small cohort sizes and prepares materials, space, and teaching resources well in advance of each batch. For this reason, the following policy applies to all intensive certification programs:

Enrolment deposit | A non-refundable deposit is required to secure your place. This covers administration, manual production, and facility reservation. The deposit is non-refundable under all circumstances. |
Balance payment | The remaining course fee is due in full on or before the first day of your programme. Students who have not settled their balance by Day 1 will not be admitted to the session. |
Cancellation more than 30 days before start | Deposit is forfeited. Any balance payments already made will be held as credit toward a future Divine Circle batch. Credit is valid for 12 months from the original batch date. No cash refunds. |
Cancellation 30 days or less before start | Deposit is forfeited. Balance payments already made will be held as credit minus a 15% late-cancellation administration fee. Credit valid for 12 months. |
Withdrawal after Day 1 | No refund or credit of any kind will be issued. The full programme fee is forfeited. |
Medical emergency with documentation | Where a medical professional provides written evidence of a condition preventing travel to India, Divine Circle will transfer the full payment to a future batch with no penalty. The transfer must be requested before the batch start date. |
7.2 Regular Classes and Drop-In Sessions
Payments for individual classes, drop-in sessions, and workshops are non-refundable. Rescheduling is available with a minimum of 24 hours advance notice. No-shows forfeit their session fee.

8. Limitation of Liability
Divine Circle takes every reasonable precaution to ensure the safety of participants. However, breathwork and sound healing are somatic practices that involve physiological and emotional activation. Participants engage voluntarily and with awareness of this.
To the fullest extent permitted by applicable law, Divine Circle’s total liability for any claim arising from participation in a program or session is limited to the fees paid by that participant for the relevant program. Divine Circle is not liable for indirect, consequential, or incidental loss of any kind.
Nothing in these terms limits Divine Circle’s liability for death or personal injury caused by its own negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.
9. Privacy and Confidentiality
Divine Circle collects personal information — including health information — for the purpose of managing enrollments, ensuring participant safety, and delivering our programs. This information is held securely and is not shared with third parties except where required by law or where necessary to ensure participant safety.
Session content, participant disclosures, and personal experiences shared within the training environment are held in strict confidence by Divine Circle and its staff. Students are also required to maintain this confidentiality in relation to their fellow participants.
Photographs and video recordings taken during the program for Divine Circle’s own use — including testimonials and social media content — require your separate written consent. You will be asked for this consent on enrollment. You may withdraw consent at any time by notifying the Divine Circle team in writing.
10. Governing Law and Disputes
These terms and conditions are governed by and construed in accordance with the laws of Uttarakhand, India. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Rishikesh, Uttarakhand, unless both parties agree to resolve the dispute through mediation or arbitration as a first step.
Divine Circle welcomes direct communication as the first approach to resolving any concern. If you have a complaint or grievance, please contact us directly before initiating any formal process. Most issues can be resolved quickly with open and respectful dialogue.
11. Complaints Procedure
If a student has a complaint about their experience at Divine Circle, they should contact Shiva directly at divinecircle.in@gmail.com. Shiva will acknowledge the complaint within 48 hours and provide a resolution within 7 days or escalation path within 21 days.
12. Changes to These Terms
Divine Circle reserves the right to update these terms and conditions at any time. Changes will be published on our website at divinecircle.org and will apply to enrollments made after the publication date. Participants who have already enrolled will be notified of any material changes that affect their program.
Participant Agreement By completing your enrolment or attending a Divine Circle programme, class, or event, you confirm that you have read and understood these Terms and Conditions and agree to be bound by them.
